General Terms and Conditions of Sale

Any order implies acceptance of the general terms and conditions of sale defined below:

ORDERS:
Orders for standard and special equipment are binding on the customer. Once production has begun, no cancellations or modifications of the order will be accepted. Orders must be placed by fax or email.

PRICES:
Prices may be revised without notice, as well as the information contained in this catalog. Information, photos, diagrams, or colors are for reference only and may be subject to changes without notice. Despite our controls, unavoidable errors may have occurred in the pricing; please contact us for further verification.

DELIVERY TIMES:
Delivery times are provided for reference only and are non-binding. Failure to meet these times cannot be grounds for order cancellation or reimbursement.

DELIVERY:
The ordered goods are delivered ex-factory. The goods travel at the buyer's risk. The buyer must note any defects regarding the packaging or goods on the delivery slip from the carrier. Any claims must be made within 24 hours of receiving the package. Packaging costs are included in the shipping costs. The buyer must specify which carrier should be used for shipping when placing the order. If this is not the case, EVO-X will use its usual carrier with shipping costs billed to the buyer.

PAYMENT:
Payments should be made according to the payment terms indicated on the sales invoice. In case of payment delay, EVO-X reserves the right to suspend deliveries of current orders and/or request advance payment for new orders.

RETAINED OWNERSHIP CLAUSE:
Pursuant to Law 90-335 of May 12, 1980, we reserve ownership of the goods until full payment of the relevant purchase invoices. In case of partial or total non-payment by the due date, we reserve the right to reclaim the products. In case of dispute, the Commercial Court of La Roche-sur-Yon is the sole competent authority.

WARRANTY:
Products are guaranteed against manufacturing defects by our suppliers for 2 years from the date of acquisition. In the case of defective products purchased directly from EVO-X, the customer must notify EVO-X in writing before taking any action. Any return of goods is at the customer’s expense. Warranty acceptance is only effective after analysis and agreement from our supplier. Only homologated exhausts are guaranteed for 2 years. Removing or dismantling a component of these exhausts invalidates the warranty. Racing exhausts, due to their use, are not guaranteed.

LIABILITY:
EVO-X declines any responsibility for improper use of the sold items. It also declines liability for any physical, moral, or material damage to any entity due to incorrect use, applications, or installations. Some items sold by EVO-X are not homologated and can only be used for private purposes, track, or events. Homologated items are clearly identified at delivery and on the items themselves. Some products are not subject to public road regulations; consult the current laws on this subject.
